Purpose & Hosting Intermediary Status
This Intellectual Property & Copyright Policy ("Policy") sets forth principles governing intellectual property rights on project listings, proposals, portfolios, and user submissions on Operis Platform ("Platform").
Operis acts as an independent "Hosting Provider" under Law No. 5651 Art. 5 and an "Intermediary Service Provider" under Law No. 6563 Art. 9, with no general obligation to pre-audit user submissions.
Platform Proprietary Assets
- 1Platform Assets: The Operis brand, logo, interface design system, software architecture, source repositories, and domain assets (operis.pro) are proprietary assets of Vellium. Operis is a product of Vellium.
- 2Usage Restrictions: No entity may modify, reverse-engineer, or deploy Operis trademarks or assets without prior written consent.
User Submissions & Project Deliverable Rights
- 1User Representations: Users warrant that text, requirements, or portfolio assets uploaded to the Platform do not infringe third-party intellectual property rights.
- 2Statutory Economic Rights Transfer (FSEK Art. 52): Assignment or licensing of statutory economic rights (Processing Art. 21, Reproduction Art. 22, Distribution Art. 23, Representation Art. 24, Public Transmission Art. 25) between Client and Contractor requires an express written contract with individualized enumeration of assigned rights pursuant to FSEK Art. 52.
- 3Inalienability of Moral Rights: Under Turkish copyright doctrine, statutory moral rights (right of disclosure, paternity, and integrity under FSEK Articles 14–16) are non-transferable; parties may only regulate exercise authorizations in their bilateral contracts.
- 4Platform Display Authorization: Users grant Operis a limited, non-exclusive, royalty-free license strictly to host, cache, index, and display public listings and profile metadata on the platform.
Notice and Takedown Procedure
Operis respects the legitimate rights of copyright holders and operates a statutory Notice-and-Takedown mechanism under FSEK Additional Article 4.
If you hold a good faith belief that content on the platform infringes your copyright, please provide a written notice with:
- 1Rightsholder Identification: Full name, legal entity information, and verifiable contact details.
- 2Identification of Work: Proof of copyright ownership, registration records, or evidence of originality.
- 3Location of Infringement: Exact URL or listing identifier on the Platform.
